Whistleblowing

TES B.V. has adopted a Whistleblowing Policy.
It is designed to encourage and enable TES collaborators, contractors, suppliers and other stakeholders to raise concerns about actual or suspected illegal, unethical or improper practices within the organization. Whistleblowing refers to the act of reporting concerns, grievances, suspicions, or information related to misconduct or violations of laws, regulations, or ethical standards within the organization.
Examples of whistleblowing, which are not limitative but purely illustrative, include corruption by external partners that could put the TES reputation at risk, workplace discrimination, environmental hazards, insufficient safety or quality of products or services, conflicts of interest, insider trading, violation of internal policies that could harm TES’ reputation, harassment, lack of regulatory compliance, criminal offences, privacy breaches, and fraud. This includes suspicions of such behavior, attempts thereto, or cover-up actions.
Persons willing to report any such unethical behavior are invited to report it to the in-house legal team at the corporate address of the relevant TES entity or via email at mailto:legal@tes-h2.com.
Any whistleblowing alerts must be made in good faith and free of any malice.
TES recognizes the importance of anonymity. Reports via email and phone can be made anonymously to protect the identity of whistleblowers. All reports and the identity of whistleblowers will be treated with confidentiality to the extent permitted by law, and information will only be disclosed to those who need to know for the purpose of investigation.
Where personal data are involved, these will be processed by TES B.V. according to the applicable privacy laws. The data will be kept for five years from the closing of the procedure concerning the alert. The personal data will be used only by the departments concerned in the processing and examination of the allegation or by the responsible judicial or other authorities. In accordance with applicable regulations, individuals may request access, rectification, or deletion of their personal data by contacting privacy@tes-h2.com.
